Affiliate Terms & Conditions

1. Overview

These Affiliate Terms govern your participation in the NakResit Affiliate Programme. By applying to or participating in the programme, you agree to these terms in full. These terms are supplementary to and should be read together with NakResit's main Terms of Service.

2. Eligibility

• You must be at least 18 years old and a legal resident or entity in Malaysia.
• You must have a valid Malaysian bank account for commission payouts.
• NakResit reserves the right to approve or reject any affiliate application at its sole discretion.
• Employees, contractors, and immediate family members of NakResit are not eligible.

3. Commission Structure

• Bronze (0–10 active subscribers): 15% commission per successful payment
• Silver (11–50 active subscribers): 20% commission per successful payment
• Gold (51+ active subscribers): 25% commission per successful payment
• Commission is calculated on the net payment amount received by NakResit (after payment gateway fees).
• Commission applies to both monthly and annual subscription payments by referred users.
• NakResit reserves the right to modify commission rates with 30 days' prior notice.
• Commissions are only tracked for referrals made after your affiliate account is approved and using your official affiliate link (AFF_XXXXXX). Prior referrals made through the general referral program are not eligible for commission conversion.

4. Referral Tracking

• You will be assigned a unique referral code upon approval.
• A referral is credited when a new user registers using your referral link and makes a qualifying subscription payment.
• Referral relationships are tracked for 90 days from the referred user's registration date.
• Self-referrals (referring yourself) are strictly prohibited.
• Cookie-based tracking: referral cookies expire after 90 days.

5. Commission Hold Period & Approval

• All commissions are subject to a 14-day hold period to allow for refunds or disputes.
• Commissions are automatically approved after 14 days if no refund or chargeback occurs.
• Approved commissions are eligible for withdrawal on the 1st of each month.
• NakResit reserves the right to reverse or claw back commissions for fraudulent referrals, chargebacks, or refunds.

6. Withdrawal & Payout

• Minimum withdrawal amount: RM50.
• Payouts are processed by the 20th of each month via bank transfer to your registered Malaysian bank account.
• NakResit is not responsible for delays caused by incorrect bank details provided by the affiliate.
• A payment voucher (PDF) will be sent to your registered email upon payout.

7. Prohibited Conduct

You must not:

• Use spam, unsolicited messages, or deceptive advertising to promote NakResit.
• Make false or misleading claims about NakResit's features, pricing, or services.
• Bid on NakResit-branded keywords in paid search advertising without prior written approval.
• Use cookie stuffing, click fraud, or other artificial methods to generate referrals.
• Create fake accounts or engage in any form of fraudulent activity to inflate commissions.
• Use the NakResit name, logo, or trademark without written permission beyond standard referral link usage.

8. Termination

• Either party may terminate the affiliate relationship at any time with written notice.
• NakResit may immediately terminate your affiliate account for violation of these terms.
• Upon termination, any pending approved commissions will be paid out within 30 days; unapproved commissions are forfeited.
• Referral links become inactive upon termination.

9. Relationship

You are an independent contractor, not an employee, agent, or partner of NakResit. Nothing in these terms creates any employment relationship. You are responsible for your own taxes, levies, and compliance with applicable Malaysian law including the Income Tax Act 1967.

10. Liability Limitation

NakResit's total liability to affiliates under these terms shall not exceed the total commissions paid to the affiliate in the 3 months preceding the claim. We are not liable for any indirect or consequential loss.

11. Amendments

NakResit may update these Affiliate Terms at any time. We will notify active affiliates by email. Continued participation in the programme after notification constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of Malaysia. Any disputes shall be resolved in the courts of Malaysia.
